Denbighshire Warning about fly tipping

Denbighshire County Council is warning members of the public to check the credentials of anyone offering to cut their hedges and trees.

Denbighshire has received reports from members of the public who have been approached by persons with a van, enquiring if they need their trees cutting or hedges trimming.

At the same time, a lot of garden debris and waste has been found dumped in the Cwm, Rhuallt & Tremeirchion areas, including:

  • Old Rhyl Bounds, 1/2 a wagon load of fruit tree cuttings/pruning
  • Old A55 Rhuallt (bridle path) 10 sacks of household rubbish and  2  1/2  wagon loads of branches
  • Back lane from Afonwen to Bodfari road, 1 full wagon of birch collected

The total amount of rubbish tipped amounts to 6¼ wagons over the last 2 weeks.

We would urge all members of the public to be vigilant and to only allow a registered waste carrier to carry out any such works. Failure to do so, can involve fines for the householders for failing in their Duty of Care.  These fines can be up to £5,000.

Section 34 of The Environmental Protection Act 1990 applies to a person who ‘produces’ waste. A producer of waste is responsible for that waste and for who they get to remove it.   A registered waste carrier will remove the waste and dispose of it legitimately and give the producer of the waste a ‘receipt’. This is known as a ‘waste transfer note’.
