Cardiff Café Smoking Prosecution

The Al Manzil Shisha Café on Cardiff’s City Road has been prosecuted for allowing smoking in an enclosed area.

Cardiff Council successfully prosecuted the owner of the Shisha lounge on 31 October 2011 at Cardiff Magistrates Court. Mr Jamel Hussen, of Al Manzil, 74 City Road, Cardiff pleaded guilty to a charge of failing to prevent people smoking in an enclosed area at the Shisha Lounge, contrary to The Health Act 2006. He was fined £1,000 and ordered to pay £200 towards the Prosecution costs.

The conviction followed an unannounced routine visit to the Shisha Lounge by Cardiff Health Improvement Officers when they found members of the public smoking inside the premises. Mr Hussen, the owner of the cafe had been previously warned about allowing people to smoke in enclosed areas.

Cardiff Council’s Health Improvement Team regularly visit premises to ensure the smoking ban is complied with. Businesses are reminded that it is an offence to allow people to smoke in a smoke-free premise. People may also be liable to a fixed penalty fine of £50 for smoking in smoke free premises.
Cllr Margaret Jones, Executive Member for Environment said: “It is illegal to smoke in an enclosed public place and it is also an offence to fail to prevent smoking in a smoke-free place.  The no smoking rule applies at all times and the council has a duty to ensure it is enforced. We will continue to take action against anyone who breaks the law this way.”
