Three Cathays Residents Fined for Noise Nuisance

Cardiff Council has successfully prosecuted three Cardiff residents for causing noise nuisance.

On 5th May at Cardiff Magistrates Court, Richard Lewis, Christopher Haughey and Steven Forrest of Richards Street, Cathays all pleaded guilty to a breach of a Noise Abatement Notice served under section 80 of the Environmental Protection Act 1990.

The case related to three offences of noise nuisance committed on 5th September 2010, 4th February 2011 and 9th April 2011, caused by amplified music being played at the property.

All three defendants were unrepresented and informed the court of their regret at having caused the noise nuisance and for not having consideration for their neighbours.

They were each fined £50; ordered to pay costs each of £105 and a court surcharge of £15 each.

The prosecution were granted a forfeiture order in relation to seven items that were seized during the last offence including speakers, a stereo, a CD player and tape deck.

Chair of Cardiff’s Public Protection Committee, Cllr. Ed Bridges said: “Loud and repetitive noise can gravely affect the quality of life of residents. It is important that persistent noise offenders are prosecuted. Cardiff’s Noise Pollution Officers are able to offer practical advice on simple measures that can be taken to avoid neighbour noise problems. Anyone wanting such advice should ring the Noise Pollution Team on 029 20872087. Where necessary, officers have powers to take formal action which can result in legal proceedings.”
